Terms of Service

Rules for using Klassi on klassi.vn. Registering, signing in, or continuing to use the service means you accept these Terms under Vietnamese law.

1. Acceptance

These Terms of Service (“Terms”) are an agreement between you and the operator of Klassi at klassi.vn (“Klassi”, “we”). You accept these Terms and the Privacy Policy when you: • Complete registration / account creation. • Sign in with email/password or Google (including first-time account creation via Google). • Link or sign in to a parent/student portal account. • Pay for / activate a paid plan. • Continue using the service after the Terms take effect or are validly updated. If you do not agree, stop using the service and do not create or keep an account. Klassi is SaaS software for class operations. We may offer free and paid plans; specific features are described at /pricing and in your account.

2. Definitions and roles

• “Service”: the Klassi platform and related features on klassi.vn. • “Teacher / Account holder”: a person who registers to create and manage classes. • “Parent / Student”: a person who accesses portals or features authorized by a teacher. • “User content”: data, files, messages, images, and class information you or your authorized users upload. Klassi is a technology intermediary. Klassi is not a party to teaching contracts with parents/students, is not a substitute education license for you (if required by law), and does not guarantee learning outcomes or teaching quality. Relationships between teachers and parents/students (tuition, schedule, teaching quality, class rules…) are those parties’ responsibility. Klassi does not represent, guarantee, or adjudicate their civil disputes unless a separate written agreement says otherwise.

3. Description of service

The Service may include (depending on plan and configuration): • Class, student, schedule, and session management. • Attendance (manual, QR, GPS, online forms). • Teacher–parent tuition status tracking and reminders. • Parent/student portals via magic links; portal account linking. • Messaging, materials, Q&A board, interactive practice. • Public teacher pages and contact forms. • Class AI and usage quotas (if included in the plan). • Transactional email/push when enabled. We may improve, suspend, limit, or change features for technical, security, legal, or business reasons, with reasonable notice when changes materially affect paying users — except emergencies (security, outages, authority orders).

4. Accounts and security

4.1 Eligibility Teacher account holders must be at least 18 and have full civil capacity under Vietnamese law. You must provide accurate registration information and keep it updated. 4.2 Security You are responsible for passwords, devices, 2FA codes, and activity under your account (except where Klassi’s security fault is established under law). Notify [email protected] immediately if you suspect unauthorized access. 4.3 Parent/student portal accounts Portal linking uses email/OTP or Google as provided. You may only link information that is yours or that you are lawfully authorized to use. 4.4 Klassi’s measures We may suspend, restrict, or terminate accounts for Terms violations, security risk, payment fraud, abuse, or lawful authority requests — with prior notice when reasonable; immediate action is allowed in emergencies.

5. Acceptable use

You must not: • Upload, store, or transmit content that violates Vietnamese law (defamation, incitement, unlawful sexual content, privacy breaches, IP infringement, fraud, etc.). • Harass, threaten, or unlawfully discriminate against parents, students, or other users. • Collect, enter, or share personal data (especially children’s data) without a lawful basis/required consent. • Impersonate others; falsify payment information; abuse referrals/promotions. • Attack systems, probe vulnerabilities without authorization, reverse engineer, scrape excessively, distribute malware, or overload the Service. • Use the Service for spam, unlawful advertising, or purposes outside lawful education/class operations. • Circumvent plan limits, improperly share paid accounts, or misuse Class AI to create harmful content. We may remove content, limit features, or report to authorities when needed to comply with law and protect users.

6. Parent/student portals and class data

Magic links (`/parent/...`, `/student/...`) may allow access without a password. Anyone with the link can view exposed data — teachers must share privately, not publicly, and revoke/regenerate if exposed. GPS check-in requires device location permission. Teachers must inform parents/guardians before requiring location-based check-in. QR camera use is for check-in scanning only; Klassi does not store camera video for that purpose. Teachers are legally responsible for accuracy of class data and correct sharing. Klassi is not liable for damages from mistaken link sharing, incorrect visibility settings, or data collected without required consent.

7. Class AI and machine-generated content

Class AI (and related AI features) are assistive tools for practice/content drafting based on materials and context you provide. You understand and agree that: • AI outputs may be wrong, incomplete, outdated, or unsuitable; they are not guaranteed educational, psychological, legal, or professional advice. • Teachers must review AI outputs before using them for teaching, assessment, or sharing with parents/students. • Students use AI with teacher/parent permission; Klassi does not monitor every prompt in real time. • Quotas, filters, and technical limits may change by plan and anti-abuse policy. • You must not use AI to create unlawful content, cheat on assessments contrary to school/class rules, or infringe others’ rights. To the extent permitted by law, Klassi is not liable for teaching/learning decisions based on AI outputs.

8. Platform fees, payment, and refunds

8.1 Klassi fees Free / Solo / Solo+AI (and other plans if any) are published at /pricing. Tax-inclusive or tax-exclusive presentation follows what is shown at checkout. 8.2 Payment Payment is via supported gateways (e.g. card/Stripe, bank transfer/VietQR/SePay, or other methods shown in-app). Successful payment is required to activate/maintain paid entitlements. 8.3 Renewal, plan changes, cancellation Subscriptions may renew on the chosen cycle (monthly/annual). You may cancel renewal / cancel at period end via in-app features when available. Plan changes may include proration as shown at confirmation. 8.4 Refunds Because digital access is provided upon payment, fees for activated periods are generally non-refundable, except where: • Law requires a refund; • A Klassi fault prevents material use for an extended period and we cannot remedy after valid notice; • We publish a separate refund policy for a specific campaign. Refund requests (if any) go to [email protected] with transaction details within a reasonable time. 8.5 Teacher–parent tuition Klassi only helps record status (paid/unpaid) and display transfer details provided by teachers. Klassi does not hold parent tuition funds, is not a tuition payment intermediary (unless a separately published feature/contract says so), and does not resolve teacher–parent tuition disputes.

9. Intellectual property

Klassi UI, software, trademarks, logos, designs, and documentation are owned by us or our licensors. You receive a limited, non-exclusive, non-transferable right to use the Service under these Terms — not a right to copy, modify, reverse engineer, create derivatives, or commercially exploit beyond the permitted scope. Your user content remains yours (or your licensors’). You grant Klassi a non-exclusive, worldwide, royalty-free license, sublicensable to processors, to store, back up, process, display, and transmit that content to operate the Service. You warrant you have lawful rights to uploaded content and that it does not infringe third-party rights.

10. Indemnification

To the extent permitted by law, you agree to defend, indemnify, and hold Klassi (and related personnel) harmless from claims, damages, and costs (including reasonable defense costs) arising from: • Content you upload; • Your collection/processing of student–parent data without a lawful basis or required consent; • Your breach of these Terms or law; • Disputes between you and parents, students, or third parties about classes/tuition/teaching quality. This does not reduce Klassi’s mandatory liabilities for our own faults under applicable law.

11. Disclaimer and limitation of liability

11.1 Nature of service The Service is provided “as is” and “as available” to the extent permitted by law. We do not warrant uninterrupted, error-free service or fitness for every particular purpose beyond public descriptions. 11.2 Exclusions (to the extent permitted by law) Klassi is not liable for: • Indirect, incidental, special, or consequential damages; lost profits, data, or business opportunity — where exclusion is allowed; • Education, tuition, or teaching-quality disputes between teachers and parents/students; • User-generated content; Class AI outputs; email/push non-delivery due to networks/mailboxes or your configuration; • Third-party acts (payment gateways, cloud providers) beyond our reasonable control after ordinary precautions. 11.3 Liability cap To the extent permitted by law, Klassi’s total liability for claims related to the Service in the preceding 12 months will not exceed the platform fees you actually paid to Klassi in those 12 months (or, for free plans, direct proven damages only, subject to legal limits). 11.4 Mandatory consumer rights Nothing excludes or limits liability that Vietnamese law (especially the Law on Protection of Consumer Rights) prohibits excluding — including liability for death/personal injury, fraud, or other non-waivable consumer rights when you are a consumer under that law.

12. Force majeure

Klassi is not liable for delay or non-performance caused by events beyond reasonable control, including natural disasters, epidemics, war, riots, widespread power/network outages, severe cyberattacks, government actions, or critical infrastructure provider failures — provided we take reasonable steps to mitigate and restore service.

13. Suspension and termination

You may close your account anytime in settings (when available) or by emailing [email protected]. We may suspend or terminate the Service (in whole or part) with reasonable notice, or immediately for serious violations, legal/security risk, or authority orders. After termination: access ends; data is handled under the Privacy Policy. IP, indemnity, liability limits, governing law, and dispute clauses survive termination.

14. Changes to these Terms

We may update these Terms. New versions are posted at /terms with an effective date. Material changes (fees, plan entitlements, liability limits…) will be announced by email and/or in-app before or when effective, where reasonable. If you disagree, stop using the Service and/or cancel your plan as instructed. Continued use after the effective date (where re-consent is not mandatory) constitutes acceptance of the new version.

15. Governing law and disputes

These Terms are governed by the laws of Vietnam. Dispute resolution order: 1) Good-faith negotiation for 30 days from written/email notice; 2) Mediation at a recognized commercial mediation body (if both parties agree); 3) A competent People’s Court in Vietnam. For qualifying consumer disputes under the Law on Protection of Consumer Rights, consumers retain statutory complaint, denunciation, and lawsuit rights — these Terms do not unlawfully restrict those rights. If any clause is held invalid, the remainder stays effective. These Terms are the entire agreement on their subject and supersede prior agreements on the same subject (except separately executed written agreements). The Vietnamese version prevails if translations differ.
